Abstract

This article reviews the landmark case of D. K. Basu vs. State of West Bengal and the guidelines issued by the Supreme Court of India to curb custodial torture. The author examines the constitutional safeguards and statutory provisions related to custodial deaths, analyze relevant precedents, and evaluate the impact of the judgment on India’s legal system. The article suggests ways to address the persisting issue of custodial torture and emphasizes the need for continuous efforts and updates to protect human rights effectively.
